Per NMDOT 2019 618.3.1, if the Contractor fails to comply with the approved traffic-control Plan or fails to immediately correct unsafe traffic conditions after written notice, the Project Manager may suspend operations, and if the Department performs the corrections the Contractor shall reimburse the Department's costs plus:

1. An additional 50% liquidated-damage surcharge on the entire Contract
2. Nothing; the Department absorbs the cost
3. Only the TCS overtime, with no administrative markup
4. An additional 10% for administrative costs
