Post-accident drug and alcohol testing under 49 CFR § 382.303 is required when the accident involves:

1. Any fender bender regardless of severity
2. A fatality (always test), or a citation against the CMV driver combined with bodily injury requiring medical treatment away from the scene or a vehicle requiring tow-away
3. Only when the driver requests it
4. Only when a passenger is present
